Welcome to Betite the Label. Our website and online store are operated by Betitethelabel Pty Ltd, trading as Betite the Label, ABN 70 689 027 487 (“we”, “us” or “our”).

These Terms apply when you use our website or shop with us. Please read them together with our Shipping Policy and Refund Policy. Our Privacy Policy explains how we handle your personal information.

1. Your consumer rights

Nothing in these Terms or our policies excludes, restricts or modifies any rights or remedies under the Australian Consumer Law or other laws that cannot legally be excluded.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

2. Orders and payment

Please check your items, size, colour and delivery details before placing an order. You must provide accurate information and be authorised to use your chosen payment method.

Placing an order is an offer to purchase. An automated order confirmation acknowledges receipt; we accept your order when we send a shipping confirmation, unless we expressly accept it earlier.

Before acceptance, we may decline an order because of stock unavailability, unsuccessful payment, reasonably suspected fraud, a material pricing or listing error, a disclosed purchase limit or a legal restriction.

If we decline your order, we will notify you promptly and refund any payment collected. We will not increase the price or substitute a materially different product without your agreement.

If we cannot supply an accepted order, we will contact you promptly and refund any products we cannot supply. Your other legal rights remain unchanged.

3. Products and pricing

We take reasonable care to display accurate product descriptions, photographs and prices. Colours may vary slightly due to lighting and screen settings.

Please review the size guide, measurements and care information before purchasing.

Unless stated otherwise, prices are in Australian dollars and include GST where applicable. Shipping and other charges imposed by us are shown before you submit your order.

We may update products, prices and promotions for future purchases. These changes do not affect accepted orders.

4. Shipping, cancellations and returns

Our Shipping Policy and Refund Policy explain delivery arrangements, order changes and returns.

Please contact us promptly if there is a problem with your order.

5. Using our website

You must not use our website for fraud, unlawful activity, harassment, infringement of another person’s rights or interference with website security.

If you create an account, take reasonable steps to keep your login details secure and notify us of suspected unauthorised access.

We may restrict access where reasonably necessary to address a security risk, unlawful conduct or a material breach of these Terms. Where appropriate, we will explain the issue and give you an opportunity to resolve it.

Any restriction does not remove your rights relating to existing orders or refunds.

6. Our content

Our brand, photographs, designs, text and other website content belong to us or their respective owners.

You may browse our website for personal use and share links to public pages. You must not copy, modify or commercially use protected content without permission, unless permitted by law.

7. Website and third-party services

Our store is hosted by Shopify, but purchases are made with Betite the Label.

We take reasonable care to maintain our website, although temporary interruptions and technical errors may occur. Third-party services may have their own terms and privacy policies.

Nothing in these Terms removes our responsibility for accepted orders, our own conduct or any liability that cannot legally be excluded.

To the extent permitted by law, we are not responsible for loss caused by your unlawful use of the website, except where our conduct contributed to that loss.

8. Changes and general terms

We may update these Terms and publish the revised version on our website. Changes apply prospectively; existing orders remain governed by the Terms that applied when they were placed, unless you agree otherwise or the law requires a change.

If a provision is unenforceable, the remaining provisions continue to apply.

These Terms are governed by the laws of New South Wales and applicable Australian law. Nothing prevents you from using a court, tribunal or complaints process available under applicable law.
